1. Agreement to These Terms
These Terms & Conditions ("Terms") govern your use of the Found NZ mobile application and the Found NZ website (together, the "Service"). By downloading, accessing, or using Found NZ, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
If you downloaded Found NZ from the Apple App Store, your use of the app is also subject to Apple's Licensed Application End User License Agreement and the Apple Media Services Terms. Where those Apple terms conflict with these Terms in relation to your purchase through Apple, the Apple terms apply.
2. What Found NZ Is
Found NZ is an activity discovery app that helps people find things to do across New Zealand — a curated catalogue of activities, places, and experiences, with filters, recommendations, and estimated drive times from your location.
Found NZ is a discovery and information tool only. We do not operate, own, endorse, or take bookings for any of the venues or activities listed, and we are not a party to any transaction between you and a venue or activity provider.
3. Accuracy of Information
We work hard to keep the activity catalogue accurate and up to date, but details such as opening hours, prices, facilities, seasonal availability, addresses, and access conditions are controlled by third parties and can change without notice.
- Always check with the venue or operator directly before travelling, especially for long drives, bookings, or paid activities.
- Drive times are estimates calculated from road-network data and typical conditions. Actual travel times vary with traffic, weather, road closures, and route choice.
- Information in the app is provided in good faith but is not a guarantee that an activity is open, available, safe, or suitable for you.
If you spot something wrong, we'd genuinely appreciate it if you told us via the in-app feedback feature.
4. Your Safety Is Your Responsibility
Many activities featured in Found NZ take place outdoors or involve physical activity — beaches, tracks, swimming spots, playgrounds, and similar. You are responsible for your own safety and the safety of anyone in your care, including children. Assess conditions on the day, follow signage and official guidance (including from the Department of Conservation, local councils, and Land Search and Rescue), supervise children around water at all times, and use your own judgement about what is suitable for your group.
5. Subscriptions and Payment
- Found NZ requires a paid subscription, purchased through and billed entirely by Apple. Prices are shown in the app before you buy.
- Where offered, an introductory free trial converts to a paid subscription at the end of the trial period unless you cancel before it ends.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your iPhone's Settings → your name → Subscriptions.
- Cancelling stops future charges; you keep access until the end of the period you have already paid for. Payments already made are generally non-refundable by us — refund requests are handled by Apple at reportaproblem.apple.com.
- We may change subscription pricing for future billing periods. If we do, you will be notified in accordance with Apple's rules and can cancel before the new price takes effect.
6. Feedback You Submit
The app lets you send us feedback anonymously. By submitting feedback, you grant us a perpetual, royalty-free right to use it — for example, to correct listings, fix bugs, and improve the Service — without any obligation or compensation to you. Please do not submit anything unlawful, offensive, or that infringes someone else's rights, and do not include personal information unless you want us to see it. 7. Acceptable Use
You agree not to:
- Copy, scrape, resell, or redistribute the Found NZ activity catalogue or any substantial part of the Service's content or data;
- Reverse engineer, decompile, or tamper with the app, or attempt to gain unauthorised access to our systems or databases;
- Use the Service in any way that is unlawful or that interferes with its operation or with other users;
- Use automated tools to access the Service without our prior written permission.
8. Intellectual Property
The Found NZ app, name, design, curated activity catalogue, and original content are owned by us and protected by copyright and other intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the app for your own private, non-commercial use. Photographs in the app are used under licence from their respective sources; venue names and trademarks belong to their respective owners and their appearance in the app does not imply any affiliation or endorsement. Drive time estimates are derived from Google Maps Platform and remain subject to Google's terms.
9. Third-Party Services and Links
The Service relies on third-party providers (Apple, RevenueCat, Google Maps services, and Supabase — see our Privacy Policy) and may link to third-party websites such as venue pages. We are not responsible for the content, availability, or practices of third parties.
10. Availability and Changes to the Service
We aim to keep Found NZ available and working well, but the Service is provided on an "as is" and "as available" basis. We may add, change, or remove features or catalogue content at any time, and we do not guarantee uninterrupted or error-free operation. We may suspend or terminate access to the Service for anyone who breaches these Terms.
11. Liability
Nothing in these Terms limits any rights you have under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded. If you are using the Service for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply.
Subject to the above, to the maximum extent permitted by law:
- We are not liable for any loss, injury, damage, cost, or inconvenience arising from your visit to, or participation in, any venue or activity discovered through the Service;
- We are not liable for inaccuracies in third-party information such as opening hours, prices, availability, or drive times;
- We are not liable for indirect or consequential loss; and
- Our total liability to you in connection with the Service is limited to the amount you paid us in subscription fees in the 12 months before the event giving rise to the claim.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this document. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
